Terms of Service

1. What reallyfinal is

reallyfinal lets you send files through a single link and, optionally, get paid before the recipient downloads them. When you enable a paid transfer, the recipient pays the price you set before the files unlock.

We are a platform and payment facilitator, not a party to the agreement between you and your recipient. The work delivered, its quality, and any contract around it are strictly between the sender and the recipient. We don’t mediate that relationship beyond moving the file and the funds.

2. Eligibility and accounts

• You must be at least 18 and able to enter into a binding contract.
• Sending a free transfer does not require an account.
• Getting paid requires an account and completing payment onboarding with our payments provider (Stripe), including any identity and tax checks they require.
• You are responsible for activity under your account and for keeping your sign-in secure.

3. Acceptable use

You agree not to use reallyfinal to upload, send, or sell:

• content you don't have the rights to distribute;
• malware, or anything designed to harm a device or network;
• unlawful, infringing, or fraudulent material;
• content that violates the privacy or rights of others.

We may remove content, cancel a transfer, or suspend an account if we reasonably believe these terms or the law have been breached.

4. Files, limits, and expiry

• Free transfers support up to 3 GB across multiple files.
• Transfers expire and the files are automatically deleted 30 days after they are created.
• Files are stored within the European Union and encrypted in transit and at rest.
• Keep your own copy. We are not a backup service, and we are not liable for files removed at expiry.

5. Paid transfers, fees, and payouts

• Platform fee. During our introductory period the platform fee is 0% (waived), so reallyfinal takes no cut of paid transfers. Any future fee will be a percentage of each paid transfer and will come out of your payout, never added to the price the recipient pays. Stripe’s own processing fee still applies.
• Payments. All payments are processed by Stripe. By accepting payment you also agree to the Stripe Connected Account Agreement. We never see or store full card details.
• Payouts.Funds are paid out to you through your connected Stripe account, on Stripe’s payout schedule. Payouts may be delayed or held where required for verification, fraud prevention, or by law.
• Currency. Prices and fees are in euros (EUR) unless stated otherwise.

6. Your taxes and invoicing

You are solely responsible for your own taxes and for issuing any invoice your client needs for the work you deliver. The fee is a platform fee charged by reallyfinal for the use of the service. A VAT invoice for the platform fee is available on request. Nothing here is tax advice.

7. Your content and intellectual property

You keep all rights in the files you send. You grant us a limited licence to host, process, and transmit them only as needed to run the service (store the transfer, deliver it to the recipient, and process payment). The reallyfinal name, brand, and site are ours and may not be used without permission.

8. Availability

The service is provided on an “as is” and “as available” basis. We don’t guarantee uninterrupted availability and may change, suspend, or discontinue features. We’ll try to give reasonable notice of material changes where we can.

9. Disclaimers and liability

To the fullest extent permitted by law, we are not liable for disputes between senders and recipients, for files lost after expiry, or for indirect or consequential loss. Our total liability for any claim is limited to the total fees you paid us in the 12 months before the claim.

Nothing in these terms limits any rights you have as a consumer that cannot be limited or excluded under the applicable law, including your statutory rights under EU consumer protection law.

10. Termination

You can stop using reallyfinal at any time. We may suspend or close an account for breach of these terms or where required by law. Provisions that by their nature should survive termination (fees owed, IP, liability, governing law) will survive.

11. Changes to these terms

We may update these terms from time to time. The “last updated” date above shows the current version. Continued use after a change means you accept the updated terms.

12. Governing law and disputes

These terms are governed by the laws of the country in which the provider is established, without prejudice to the mandatory consumer-protection rules of your country of residence. The courts of the provider’s place of establishment have jurisdiction, except where consumer law gives you the right to bring proceedings in your own country.
